("11stOriginal-Seafarer一份-海员自己保存2ndOrigianl-CompanyFile一份-公司存档3ndCopy-Ship’sFile一份-船舶存档SEAFARER’SEMPLOYMENTAGREEMENT海员就业协议No.(编号):SHXR-2013021Accordingtotheprincipleofequalityandvoluntariness,thisagreementissignedbetweentheseafarerandemploy/company/shipowner/agentoftheshipM.Vafterfriendlyconsulting,根据平等自愿原则,经友好协商,海员和雇主(公司或船东或代理机构)就服务于M.V一事签署如下协议。THESEAFARER(海员)Surname(姓):GivenName(名):Dateofbirth出生日期:Placeofbirth出生地点:Nationality国籍:Fullhomeaddress:详细家庭地址:Seaman’sbookNo.海员证号码:PassportNo.护照号码:Medicalcertificateissuedon健康证签发日期:Positionofemployment受雇职务:Estimatedtimeoftakingupposition预期任职时间:Portofwherepositionittakenup任职港口时间:HereafterreferredtoasSeafarer(以下简称海员)THEEMPLOYER(雇主)Name:名称:Address:地址:HereafterreferredtoastheEmployer(以下简称雇主)THESHIP(船舶)Name船名:Flag船旗:IMONo.国际编号:GrossRegisteredTonnage(GRT)总吨位:YearBuilt建造时间:VesselType船舶类型:TradeArea服务航区:ClassificationSociety船级社名称:GENERALTERMSOFTHEAGREEMENT协议总条款Periodofemployment雇佣期限:monthsWagesfromandincluding工资起算日:Basichoursofworkperweek每周基本工作时间:hrsMonthlyBasicwageMonthlyfixedovertime(103hrsOvertimerateofhoursworkedinexcessof103hrs2基本工资:guaranteed)加班津贴:加班费率:1.25perhourMonthlyLeavepay月休假待领薪:LeaveSubsistence:社保等:Annualleavepay:(2.5dayswagespermonthfortheperiodserviceonboard)年休假待领薪:(2.5天工资服务船上月数)SubAllowance:其他补贴:Total总额:Officialholidays:12daysannual法定假日:12天/年MonthlyPerformanceAppraisalAward月度绩效奖:YearlyPerformanceAppraisalAward年度绩效奖:年度绩效奖下船后一个月内发放YearlyPerformanceAppraisalAwardWillBePayedForInOneMonthAfterOverboard1.TheSeafarerhasread,understoodandagreedtothetermsandconditionsofemploymentasidentifiedinfollowingsandentersintothiscontractfreely.海员本人已经阅读、理解并同意本《海员就业协议》之内容,并本着在自愿地基础上签订该协议INWITNESSWHEREOFthepartieshaveheretosettheirhandsthisdayofat特此证明:各有关方于在签署协议_Seafarer(海员)For/onbehalfoftheEmployer(雇主)3STANDARDTERMSANDCONDITIONSGOVERNINGSEAFARER’SEMPLOYMENTCONTRACT适用于船员就业协议的标准术语和条款:DefinitionofTerms;术语定义Forpurposeofthiscontract,thefollowingtermsaredefinedasfollowing:为了有效实施该协议,相关术语定义如下:1.PointofHire-referstotheplaceindicationthecontractofemploymentwhichshallbebasisfordeterminingcommencementandterminationofcontract.1.雇佣地-是指一个用于确定就业协议开始和终结的基准地。2.ConvenientPort-anyportwhereitispracticable,economical,safeandconvenienttorepatriatetheseafarer.2.方便港-指任何可行的、方便的、安全的和经济的能安排船员休假的港口。3.BasicWage-referstothesalaryoftheseafarerexclusiveofovertime,leavepayandotherbonuses.3.基本工资-指除加班工资、休假带薪、其他奖金以外的船员薪金。4.Departure-referstotheactualdeparturefromthepointofhireoftheseafarerthroughair,seaorlandtraveltransporttojoinhisvessel.4.出发-指海员通过海、陆、空中任何一种交通方式实际地从雇佣地前往上船。5.RegularWorkingHours-referstotheseafarer’seight(8)hourworkingwithintheperiodof24hours.5.正常工作时间-指24小时内海员所要完成的8小时工作时间。6.Shipwreck-referstothedamageordestructionofavesselatseacausedbycollision,stormgroundingoranyothermarineperilatseaorinportrenderingthevesselabsolutelyun-seaworthinessorunabletopursuehervoyage.6.船舶失事-指在海上由于碰撞、风暴、搁浅,任何其他海滩或在港内所造成的船舶损害已经导致绝对不适航或不能实施其既定的航次。7.CompassionateGround-referstoincidenceofdeathofanimmediatememberoftheseafarer’sfamilywhichincludeshisparents,spouseandchildreniftheseafarerismarriedorhisparentsiftheseafarersissingle.7.体恤事件-指海员直系亲属死亡事件,直系亲属对已婚海员是指其父母、配偶和子女;对未婚海员是指其父母。8.Principal-anyperson,partnershiporcorporationhiringseafarerstoworkonboardvessel.8.雇主-指任何雇佣海员上船为其服务的人、合伙人或公司。SECTION1.DUTIES第一部分职责A.DutiesoftheEmployer/agency/masterA.雇主、代理人、船长的职责1.Tofaithfullycomplywiththestipulatedtermsandconditionsofthiscontract,particularlythepromptpaymentofwages,remittanceofallotmentandexpeditiousofvalidclaimoftheseafarer.1.如实地履行本合同所订立条款,尤其是及时支付船员工资,汇款的分配和迅速有效处理海员的索赔。2.ToextendcoveragetotheseafarerunderPRCSocialSecuritySystem.2.按照中华人民共和国社保体系规定实现对船员的社保覆盖。3.Tomakeoperationalonboardthevesselthegrievancemachineryprovidedinthiscontractandensureitsfreeaccessatalltimesbytheseafarer.3.使申诉机制在船有效运作,并确保在任何时候船员免费提供服务。44.Toprovideaseaworthyvesselfortheseafarerandtakeallreasonableprecautionstopreventaccidentandinjurytothecrewincludingprovisionofsafetyequipment,fireprevention,safeandpropernavigationofthevesselandsuchotherprecautionsnecessarytoavoidaccident,injuryorsicknesstoseafarer.4.为船员提供适航船舶,采取各种合理预防措施来防止事故和对船员形成伤害,这些合理措施包括:指定安全设备指引、防火、船舶安全妥当航行和其他防止事故或船员伤病的必要防御措施。5.ToobservetheCodeofEthicsforSeafarersandconducthimselfinthetraditionaldecorumofamaster.5.遵守船员职业道德操守并按传统船长礼仪行事。6.Urgetheship’sownertoprovideaworkplaceconduciveforthepromotionandprotectionofthehealthoftheseafarersinaccordancewiththestandardsandguidelinesinTitle4oftheILOMaritimeLabourConvention,2006.6.敦促船东根据国际劳工组织《2006海事劳工公约》第4章标准和指引要求为船员提供有益于船员健康和发展的工作场所。B.DutiesoftheSeafarerB.船员职责1.Tofaithfullycomplywithandobservethetermsandconditionsofthiscontract.1.诚实地遵守和履行本合同所订立条款。2.TobeobedienttolawfulcommandsoftheMasteroranypersonwhoshalllawfullysucceedhimandtocomplywithcompanypolicyincludingsafetypolicyandproceduresandanyinstructionsgiveninconnectiontherewith.2.遵守船长及船长合法接班人的合法指令,遵从公司政策包括公司安全政策以及为这些政策而推出的配套规则。3.Toabidebythedutyin“SeafarerRegulationsofThePeople’sRepublicOfChina”andtheCodeofEthicsforSeafarer.3.遵守《中华人民共和国船员管理条例》中所规定的船员职责和船员职业道德操守。4.Tobediligentinhisdutiesrelatingtothevessel,itsshoresandcargo,whetheronboard,inboatsorashore;and4.不分在船、在岸和其它场所,尽职于本人职务,都要做所对应的对船、对岸和对货事务,并5.Toconducthimselfinanorderlyandrespectfulmannertowardsoperator,portauthoritiesandotherpersonsonofficialbusinesswiththeship.5.有理有节的行事准则来接待码头的操作人员、港口当局官员和其他与船舶正常营运有关的人士。SECTION2.COMMENCEMENT/DURATIONOFCONTRACT第二部分合同期及合同那个起始A.Theemploymentcontractbetweentheemployerandtheseafarershallcommenceuponactualdepartureoftheseafarerfromtheinternationalairportinthepointofhireoractualboardingthevesseldesignatedbytheemployerwhicheverisearlier.Itshallbeeffectiveuntiltheseafarer‘sdateofarrivalatthepointofhireuponterminationofhisemploymentpursuanttoSection15ofthisContract.A.该份合同从船员实际离开雇佣地国际机场或船员实际上到雇主所指定的船舶中较早一个时间开始生效,该合同终止于根据该合同第15部分规定船员到达雇佣地时。B.Theperiodofemploymentshallbeforaperiodmutuallyagreeduponbytheseafarerandtheemployerbutnottoexceed12months.Anyextensionofthecontractshallbesubjecttothemutualconsentofbothparties.B.合同期由雇佣双方确定,但合同期不得超过12个月。任何对已经签订合同的延长需由双方共同同意。SECTION3.FREEPASSAGEFORMTHEPOINTOFHIRETOTHEPORTOFEMBARKATION第三部分从雇佣地到上船港的免费行程Theseafarershalljointhevesselorbeavailablefordutyatthedate/timespecifiedbytheemployer.Theseafarershalltravelbyairorasotherwisedirectedattheexpenseortheemployer.船员应该在雇主规定时间上船任职。船员乘飞机或其他交通方式上船所产生的费用应由雇主承担。SECTION4.BAGGAGEALLOWANCE5第四部分行李额度Theseafarertravellingbyairtojoinavesseloronrepatriationshallbeentitledtothenormalfreebaggageallowanceofferedbyairlines.Generally,30kgforinternationalpassagewithsizelimitationbyairlinesor20kgfordomesticpassagewithlimitationbyairlines.Thecostoftheexcessbaggageshallbefortheaccountoftheseafarer.船员乘飞机或公休可以享受航空公司所提供的正常免费行李额度。通常情况下,国际航段是按航空公司行李尺寸限制下的30公斤或国内航段是按航空公司行李尺寸限制下的20公斤。超过正常行李额度部分应由船员本人承担费用。SECTION5.HYGIENEANDVACCINATION第五部分卫生和预防接种A.Theseafarershallkeephisquartersandotherlivingspaces-suchasmessrooms,toilet,bathrooms,alleywaysandrecreationroomsincleanandtidyconditiontothesatisfactionofthemaster.Theworkistobeperformedoutsidetheseafarer‘sregularworkinghoursandforwhichnoovertimepayshallbeclaimed.A.船员应该使自己起居的处所和其他居住场所保持到船长满意的干净和整洁的程度,这些场所包括餐、厕所、浴室、走廊和休息室等。对这些场所进行的清洁工作应该在船员正常工作时间以外进行,该部分时间不得记作加班时间。B.Theseafarershallsubmittotheorderofthemasterortothelawsofanycountrywithintheterritorialjurisdictionofwhichthevesselmayentertohavesuchvaccinationorinoculationortoundertakermeasuressafeguardinghishealthandofthewholecrew.B.为确保船员本人和在船全体船员健康,船员应该按船长或任何船舶可能驶往港口法律规定而进行预防接种。SECTION6.WAGES第六部分工资A.Theseafarershallbepaidhismonthlywagesnotlaterthan20daysofsucceedingmonthfromthedateofthecontractuntilthedateofarrivalatpointofhireuponterminationofhisemploymentpursuanttosection15ofthisContract.A.根据本合同第15部分规定,从合同起始到合同终止期间船员工资应按月支付并不得晚于下月20号。B.Seafarersshallconductthemselvesinanorderly,faithful,honestandshallatalltimesbediligentintheirrespectivedutiesandobedienttothelawfulcommandsoftheMaster,orofanypersonwhoshalllawfullysucceedhim,andtheirsuperiorofficers,ineverythingrelatingtothevessel,itsstoresandcargo,whetheronboard,inboatsoronshore.Inconsiderationofthisservice,tobedulyperformedtheMasteragreestopaytheundersignedseafarersthewagesexpressedhereinand/orsetforthinsupplementalprovisionsand/oragreements.B.海员应保持忠实、诚信的态度和有序、冷静的处事方式,在任何时候都应该认真履行各自的职责,不论在船上或是在岸上,都应服从船长或任何依法继任者和上级海员关于船舶、储藏和货物等方面的合法指挥。作为海员充分履行此义务的报酬,船长同意按照本合同规定和/或补充条文规定和/或协议支付海员工资。C.WagesshallcommencenolaterthanonthedayspecifiedandagreedtointheseArticlesoratatimeofpresenceonboardforthepurposeofcommencingworkwhicheverfirstoccursandshallterminateonthedayofdischarge.C.工资自合同规定和约定的日期或开始上船工作的日期起(以最早的日期为准)至将海员解雇或合同终止之日。D.IftheMasterandaseafareragreeaportionofsuchseafarer‘searningsmaybeallottedtosuchseafarer’sspouse,children,grandparents,brothersorsisters,ortoabankaccountinthesameoftheseafarer.D.如果船长和海员同意,海员的部分收入可分配给该海员的配偶、子女、孙子女、父母、祖父母、兄弟姐妹或存至该海员名下的银行账户。SECTIONG7.HHOURSOFWORKORREST第七部分工作或休息时间A.Allseafarersshallbeprovidedwitharestperiodofnotlessthan:A.应提供给所有海员下列最短休息时间:i.Daily-aminimumof10hoursofrestinany24-hourperiod;6每天:在任何24小时时段内不得少于10小时;ii.Weekly-77hoursinany7dayperiod.每周:在任何7天时间内不得少于77小时。B.Thehoursofrestmaybedividedintonomorethantwoperiod,oneofwhichshallbeatleastsixhoursinlength,andtheintervalbetweenconsecutiveperiodsofrestshallnotexceed14hours.Ashortbreakoflessthan30minuteswillnotbeconsideredasaperiodofrest.B.休息时间最多可分为两段,其中一段至少要6小时,且相连的两段休息时间的间隔不得超过14小时。短暂的少于30分钟的休息时间不被认为是一段休息时间。C.Musters,fire-fighting,lifeboat,securityandoil-spilldrill,safety&securityexercisesdrillwillbearrangedinamannerthatminimizesthedisturbanceofrestperiodsanddoesnotincludefatigue.C.应急集合、消防、弃船、保安、益油等演习应以对休息时间的影响最小和不会造成疲劳的方式进行。D.TheMastershallensurethatadequatecompensatoryrestperiodisprovidedifthenormalperiodofrestisdisturbedforcall-outstowork,suchaswhenamachineryspaceisunattended,duringthenormalhoursofrest.Anycompensatoryrestprovidedshallbeconsistentwithminimumresthourrequirementsinany24-hourperiod.D.如果正常的休息时间被紧急的工作打断,船长应确保对休息时间予以补偿,补偿的最低休息时间应满足24小时内的最低休息标准。E.Atablefortheshipboardworkingarrangementispostedonboardinanaccessibleplace.Thetablecoverseverypositionandshallcontainatleast:E.船上应张贴一份船上工作安排表,该表格应该至少包括每一岗位的下列内容:(a)Positionoftheseafarer;船员的职位;(b)thescheduleofserviceatseaandserviceinport;and在海上和在港口的工作时间表;和(c)theminimumhoursofrestorthemaximumhoursofwork.最少休息时间。F.Recordsofseafarers’dailyhoursofworkordailyhoursofrestaremaintainedintheformatinEnglishandChinese,toallowmonitoringofcompliancewithprovisionsundertheaboveparagraphs6.1-6.4inclusive.Theseafarersaregivenacopyoftherecordspertainingtothemwhichareendorsedbythemaster,orapersonauthorizedbythemaster,andbytheseafarers.F.海员每天的休息/工作时间应用英文记录,并要符合经修改的国际劳工组织关于制定海员船上工作安排及海员工作或休息时间记录格式的指导,保持记录以便监督是否符合上述6.1-6.4的规定。海员应得到一份由船长或船长授权人员以及海员本人签字认可的日工作时间或日休息时间的记录的副本。G.Themasteroftheshiphavetherighttorequireaseafarertoperformanyhoursofworknecessaryfortheimmediatesafetyoftheship,persononboardorcargo,orforthepurposeofgivingassistancetoothershipsorpersonsindistressatsea。Accordingly,themastermaysuspendthescheduleofhoursofrestandrequireaseafarertoperformanyhoursofworknecessaryuntilthenormalsituationhasbeenrestored.Assoonaspracticableafterthenormalsituationhasrestored,anyseafarerswhohaveperformedworkinaschedulerestperiodwithanadequateperiodofrestbythemaster.G.船长有权出于船舶、船上人员或货物的紧急安全需要,或出于帮助海上遇险的其他船舶或人员的目的而要求一名海员在任何时间进行工作。为此,船长可中止休息时间安排,要求一名海员从事必要工作,直至情况恢复正常。一旦情况恢复正常,船长应尽快地确保所有在计划安排的休息时间内从事工作的海员获得足够的休息时间。H.Inordertoensureacontinuedsafeoperationoftheshipinexceptionalconditions,certainexceptionsfromthenormalrequirementsfortherestperiodsareallowedprovidedthattherestperiodisnotlessthan70hoursinany7dayperiodandoncertainconditions,namely:H.为确保在例外情况下船舶的持续安全操作,允许所规定的休息时间有例外,但在任何7天内的休息时间不得少于70小时,且:Suchexceptionalarrangementsshallnotbeextendedformorethantwoconsecutiveweeks;上述例外的安排不得超过连续两个星期;Theintervalsbetweentwoperiodsofexceptionsshallnotbelessthantwicethedurationoftheexception;7在船上连续两次例外时间的间隔不应少于该例外持续时间的两倍;Thehoursofrestmaybedividedintonomorethanthreeperiods,oneofwhichshallbeatleast6hoursandnoneoftheothertwoperiodsshallbelessthanonehourinlength;休息时间可以分成为不超过3个时间段,其中之一至少为6小时,而另外两个时间段均不应少于1小时。Theintervalsbetweenconsecutiveperiodsoftherestshallnotexceed14hours;and连续休息时间段间隔不得超过14个小时。Exceptionsshallnoextendbeyondtwo24-hourperiodsinany7-dayperiod.例外在任何7天时间内不得超过两个24小时时间段。SECTION8.OVERTIME&HOLIDAYS第八部分加班时间和节假日A.Theseafarershallbecompensatedforallworkperformedinexcessoftheregulareight(8)hoursabove.Overtimepaymaybeclassifiedasopen,fixedorguaranteed.Incomputingovertime,afractionofthefirsthourworkedshallbeconsideredasonefullhour.Afterthefirsthourovertime,anyworkperformedwhichislessthanthirty(30)minutesshallbeconsideredashalfanhourandmorethanthirty(30)minutesshallbeconsideredonefullhour.A.船员所从事的按前述规定所确定的8小时以外的工作应按加班进行补偿,加班补贴可以分为开放式、固定式、保障式。在计算加班时间应按以下方式进行:第1小时及不足1小时应记作1小时;第1小时后不足30分钟记作30分钟,超过30分钟不足1小时记作1小时。B.Overtimeworkmaybecompensatedatthefollowingrates:B.加班工作应该按以下规则进行补偿:1.Openovertime-notlessthan125percent(125%)ofthebasichourlyratecomputedbasedontwohundredeight(208)regularworkinghourspermonth.1.开放式加班,以每月208小时工作时间为标准,加班工资的小时工资率不得少于1.25倍正常工作的小时工资率。2.GuaranteedorFixedOvertime-notlessthanthirty(30%)percentofthebasicmonthlysalaryoftheseafarer.ThisfixedrateovertimeshallincludeovertimeworkperformedonSundaysandHolidaysburshallnotexceedonehundredfive(105)hoursamonth.2.保障式或固定式加班-该类加班方式不得少于船员基本工资的30%。固定加班方式应该包括在周日和节假日所进行的加班工作,但固定加班方式下的加班总时间不得超过105小时每月。3.Overtimeworkforofficersshallbecomputedbasedonthefixedovertimerate.3.对干部船员加班计算应该以固定加班方式进行。4.Forrating,overtimeworkshallbebasedonguaranteedoropenovertimerate,asmutuallyagreeduponbythecontractingparties.Overtimeworkinexcessof105hoursamonthforratingsshallbefurthercompensatedontheopenovertimerate.4.对普通船员加班计算是按固定加班式或保障式可由合同签订双方共同同意。对于超过105小时的加班应该以开放式加班费率对船员进行补偿。C.EmergencyDuty-Noovertimeworkshallbeconsideredforanyworkperformedincaseofemergencyaffectingthesafetyofthevessel’passenger,creworcargo,orwhichthemastershallbethesolejudge,orforfire,boat,oremergencydrillorworkrequiredtogiveassistancetoothervesselsorpersonsinimmediateperil.C.应急职责-因以下工作而产生的加班不记做加班时间:在船长独立判断后认为有影响船舶、旅客、船员或货物安全的紧急情况下所进行的加班消防演习、救生演习、应急操练或出于帮助海上遇险的其他船舶和人员需要而进行的加班。SECTION9.LEAVEPAY8第九部分休假带薪Terseafarer’slaevepayshallbeinaccordancewiththenumberofdaysleavepermonthasagreedupon.Daysleaveshallbelessthantwoandahalf(2.5)daysforeachmonthofserviceandpro-rated.Leavepayshallbesettledonboardorsettledwithintwoweeksafterarrivaloftheseafareratthepointofhire.船员休假带薪应按双方一致同意的每月天数进行支付。休假带薪天数不得少于2.5天每服务月或根据比例计算。休假带薪应该在船发放或船员到达雇佣地的两周内发放。SECTION10.SHORELEAVE第十部分上岸休假Theseafarershallbeallowedshoreleavewhenpracticable,upontheconsentofthemasterorhisdeputy,takingintoconsiderationtheoperationsandsafetyofthevessel.当实际可行的情况下,并考虑了船舶安全和船舶作业需要后,经船长或船长代理人同意船员应该被允许上岸。SECTION11.SHORELEAVE第十一部分饮食及日用A.Theseafarershallbeprovidedbythemaster/employerwithsubsistencewithgoodmaritimestandardsandpracticeswhileonboardthevesselatnocosttoseafarer.A.船员在船服务期间应该由雇主/船长免费提供满足良好和符合标准的食物。B.Allstoresandprovisionsissuedtotheseafarerareonlyforuseandconsumptiononboardthevesselandanyunusedorunconsumedstoresorprovisionsshallremainthepropertyoftheemployer.Theseafarershallnottakeashore,sell,destroyorgiveawaysuchstoresandprovisions.Seafarershouldnotallowedtoaskforsharingofanybalanceofthefoodallowance.Anydeficiencyarisingfromimpropermanagementorotheradministrativefactorsshallbemadegoodbythemasterandallstaffonboardandcannotbereimbursedbytheemployer.B.所有由雇主提供给船员的日用品和饮食都仅限于在船耗用,任何未使用/未消耗的日用品和饮食应该作为雇主财产留船。海员不得将日用品/饮食带上岸、转卖、破坏和丢弃。船员不得分发伙食结余。由于管理不当和其他管理因素而导致伙食账目亏空应该由在船船长和所有船员共同采取措施纠正,该部分亏空雇主不予补偿。SECTION12.TRANSFERCLAUSE第十二部分转船条款Theseafareragreestobetransferredatanyporttoanyvesselownedoroperated,mannedormanagedbythesameemployer,provideditisaccreditedtothesamemanningagentandprovidedfurtherthatthepositionoftheseafarerandtherateofhiswagesandtermsofserviceareinnowayinferiorandthetotalperiodofemploymentshallnotexceedthatoriginallyagreedupon.在不超过雇佣双方最初所达成原合同期限、不低于原合同所提供的薪酬和职位的条件下,船员应同意在任意港转往同一雇主所拥有或管理的船舶继续服务Anyformoftransfershallbedocumentedandmadeavailablewhennecessary.需要时转船文件和记录需要可供查询。SECTION13.GRIEVANCEMACHINER第十三部分申诉机制A.Iftheseafarerconsidershimselfaggrieved,heshallmakehiscomplaintinaccordancewithcompanyMLCmanual.Fordetailspleasereferto“SHANGHAIXUANRUNSHIPPINGCO.,LTDon-boardcomplaint-handlingprocedures”.A.如果船员认为他自己有事需要申诉-抱怨,他可以根据公司海事劳工手册进行申诉抱怨。具体细节请参见“上海轩润船务有限公司在船申诉处理程序”9B.Seafarershallreceiveacopyof“SHANGHAIXUANRUNSHIPPINGCO.,LTDon-boardcomplaint-handlingprocedures”priortodepartingfromportofhire.B.船员应该在离开雇佣地前收到一份“上海轩润船务有限公司在船申诉处理程序”。C.ThemastershallnotrefusethereasonablerequestofanyseafarerforshoreleaveforthepurposeofpresentingacomplaintacomplaintagainstthevesselorMastertoaHongKongOfficial.C.船长不能拒绝任何一个海员向香港官员投诉船舶或者船员的合理请求。SECTION14.DISCIPLINARYPROCEDURES第十四部分违纪处理程序TheMastershallcomplywiththefollowingdisciplinaryproceduresagainstanerringseafarer:船长应该按一下违纪处理程序对违纪船员进行处理:A.TheMastershallfurnishtheseafarerwithawrittennoticecontainingthefollowing:A.船长应该给违纪船员一份包含以下内容的书面通知:1.Groundsforthechargesaslistedbeloworanalogousactconstitutingthesame:1.如下所述或类似违规行为a.Involvementinfighting,gambling,intimidation,smuggling,negligenceinduty,disobediencetosuperiors’lawfulorders;damagingshipboardproperty,embezzlementofcompanyfunds;斗殴、赌博、恐吓:走私、疏于职守、不听从上级合法指示、损害船舶财产、盗窃公司财物;b.Drug/alcoholabuse;吸毒、酗酒;c.Violationlawsoflocalport;违反港口国当地法律;d.Otherbreachesofprinciplesormisbehavior.其他违纪或不法行为。2.Date,timeandplaceforaformalinvestigationofthechargesagainsttheseafarerconcerned.2.对相关违规船员正式调查的日期、时间和地点。B.TheMasterorhisauthorizedrepresentativeshallconducttheinvestigationorhearing,givingtheseafarertheopportunitytoexplainordefendhimselfagainstthecharges.Theseproceduresmustbedulydocumentedandenteredtotheship’slogbook.B.船长或其授权的代理人应该进行调查或聆听、给予被指控船员就所指控事件进行自我解释和辩护机会。这些程序必须进行记录和记入船舶航海日志。C.Ifaftertheinvestigationorhearing,themasterisconvincedthatimpositionofapenaltyisjustified,theMastershallissueawrittennoticeofpenaltyandthereasonsforittotheMaster,withcopiesfurnishedtotheManningAgent.C.如果经过调查或聆听后,船长相信对违纪船员实施处罚是正当的,船长应该向违规船员签署一份列明该项处罚理由的书面处罚通知,书面处罚通知复印件应该抄送该船员派遣公司。D.DismissalforjustcausemaybeeffectedbycompanyortheMasterwithoutfurnishingtheseafarerwithanoticeofdismissalifthereisaclearandexitingdangertothesafetyofthecreworthevessel.TheMastershallsendacompletereporttothemanningagencysubstantiatedbywitnesses,testimoniesandanyotherdocumentsinsupportthereof.D.如果有明确和现存对船舶和船舶人员安全构成危险的情况下,公司或船长有权不通知违纪船员本人的情况下开除该船员。船长应该向船员派遣公司提供一份完整的报告,该报告应该包含有见证人、证词和对此事有关的其他支持材料。SECTION15.TERMINATIONOFEMPLOYMENT第十五部分合同终止A.Theemploymentoftheseafarershallceasewhentheseafarercompleteshisperiodofcontractualserviceaboardthevessel,signs-offfromthevesselandarrivesatthepointofhire.10A.船员完成合同后离船到达雇佣地,船员雇佣合同即告终结。B.Theemploymentoftheseafarerisalsoterminatedwhentheseafarerarrivesatthepointofhireforanyofthefollowingreasons:B.船员因以下原因到达雇佣地后也定义为船员雇佣合同终结。1.Whentheseafarersigns-offandisdisembarkedformedicalreasonspursuanrtoSection17(b)(4)ofthisContract.1.船员根据本合同第17部分(b)(4)的规定病原因从船上离船。2.Whentheseafarersign-offduetoshipwreck,ship’sscale,lay-upofvessel,discontinuanceofvoyageorchangeofvesselprincipalinaccordancewithofthisContract.2.船员根据本合同的规定由于海难,船舶拆解,封存,航次终结或船舶改换船东从船上离船。3.Whentheseafarer,inwriting,voluntarilyresignsandsignsoffpriortoexpirationofcontractpursuanttoSection16(f)ofthisContract.3.船员根据本合同第16(f)部分的规定以书面形式在合同终结前自愿辞职从船上离船。4.WhentheseafarerisdischargedforjustcauseasprovidedforinSection14ofthisContract.4.船员由于本合同第14部分的规定以正当的理由被解雇离船。SECTION16.REPATRIATION第十六部分休假A.Upontheexpirationofthecontract,thecompanyshallarrangeseafarersdisembark.Ifcouldnotarrangecrewdisembarkatthisportcompanymayarrangesameatnextconvenientport.Theseafarershallbeentitledtoearnedwagesandbenefitsasprovidedinhiscontract.A.如果合同到期公司必须安排船员休假,而港口无法安排,可以安排在下一个方便港口,船员应该继续按该合同进行并获得相应的薪水和享受相关福利。B.Ifthevesselarrivesataconvenientportbeforetheexpirationofthecontract,theMaster/Employermayrepatriatetheseafarerformsuchport,providedtheun-servedportionofthecontractiswithinmutualagreeoptionrange.Theseafarershallbeentitledonlytohisearnedwagesandearnedleavepay.B.如果合同到期前船舶到达一个方便港口并且未完成合同的合同部分在双方同意的选择期限内,船长/雇主可以在这种港口让船员休假。船员只能获取他已经赚取的薪酬和已经赚取的休假带薪。C.Whentheseafarerisdischargedforduetocrewindividualsseriousderelictionofduty,theemployershallhavetherighttorecoverthecostsofhisreplacementandrepatriationfromtheseafarer’swagesandotherearnings.C.雇主因船员个人的严重失职而解聘船员,雇主有权从船员工资和其他收入中追回安排船员休假和安排接班船员所产生的费用。D.Theseafarer,whendischargedandrepatriatedasdirectedbytheemployer/master/agencyshallbeentitledtobasicwagesfromdateofsigningoffuntillarrivalatthepointofhireexceptwhenthedischargeisinaccordancewiththeaboveorfordisciplinaryreasons.D.除了是由于前述船员违规原因,对于在船长/雇主/代理人安排下进行的休假船员享有从离船到达雇佣地领取基本工资的权利。E.Aseafarerwhorequestsforearlyterminationofhiscontractshallbeliableforhisrepatriationcostaswellasthetransportationcostofhisreplacement.Theemploymentmay,incaseofcompassionateground,assumethetransportationcostoftheseafarer’sreplacement.E.申请提前公休的船员除了要负责他本人的公休成本也要负责接替他的船员的交通费用。在体恤事件条件下,雇主应该承担接班船员交通费用。F.Wheretheseafarers’employmentterminatedbecauseoftransferofregistryofownershiporabandonmentofvesselorlossofvessel.Theseafarersshallbeentitledtocompensationequalto1monthsbasewage,orthebasewagesuntiltheexpirationoftheperiodforwhichhewasengaged.Whichevershallbeleast;providedhoweverthattheseamanisnoremployedasaseamanduringsuchperiodandprovidedfurtherthatduringsuchperiodtheseafarerhasnotrefusedsubstantllyeqivalentseagoingemployment.11F.当船员合同由于船籍国的变更或者船东的变更或者弃船或者船损而终止,如果该船员在这个期间不能再次被雇佣上船,或者该船员不能获得与海上雇佣期大致相同的收入,该船员有权获得相当于1个月的基本工资的补偿,或者直到他的雇佣合同期满为止的基本工资补偿,两者取小者。G.Theminimumnoticeperiodtobegivenbytheseafarersandcompanyfortheearlyterminationofacrewagreementshallnotbeshorterthensevendays.Companyallowsseafarerstoterminatethecrewagreementasshorternoticeorwithoutnoticewithoutpenaltyforcompassionateorotherurgentreason.IncasethereisconflictwithterminationclauseasperCBAthentheterminationclauseaspercontractwillprevailprovidinganadvantageoussituationtotheseafarer.G.海员和公司提前终止海员就业协议发出预先通知的最短期限为不短于7天。公司允许海员处于值得同情的原因或其他紧急原因提前较短时间或不通知不被处罚就终止就业协议。如果与谈判协议中的终止条款有冲突,则有利于海员的终止条款优先。SECTION17.COMPENSATIONANDBENEFITS第十七部分赔偿和福利A.COMPENSATIONANDBENEFITSFORDEATHA.死亡赔偿和福利1.Incaseofwork-relateddeathoftheseafarer,duringthetermofhiscontract,theemployershallpayhisbeneficiariesasperPeople’sRepublicofChinalaws.1.一旦海员在合同期间因工作死亡,雇主要根据中华人民共和国相关法律对海员的受益人进行赔偿。2.Itisunderstoodaridagreedthatthebenefitsabove-mentionedshallbeseparateanddistinctfrom,andwillbeinadditiontowhateverbenefitswhichtheseafarerisentitledtounderPeople’sRepublicofChinalawsfromthesocialsecuritysystemetc.,ifapplicable.2.除了以上来自雇主的补偿外,双方一致同意根据中华人民共和国法律体系下的社会保险等而获取的补偿也一并归入船员补偿。3.Theotherliabilitiesoftheemployerwhentheseafarerdiesasaresultofworkrelatedinjuryorillnessduringthetermofemploymentareasfollows:3.船员在合同期间因工作原因导致的疾病和伤害而死亡时,雇主所要承担的其他赔偿责任:a.Theemployershallpaythedeceased’sbeneficiaryalloutstandingobligationduetheseafarerunderthiscontract.a.雇主应该根据本合同向死亡船员受益人转付所有归属于死亡船员的应有的福利补偿。b.HeemployershalltransporttheremainsandpersonaleffectsoftheseafarertotheChinaatemployer’sexpenseexceptifthedeathoccurredinaportwherelocalgovernmentlawsorregulationsdonotpermitthetransportofsuchremains.Incasedeathoccursatsea,thedispositionoftheremainsshallbehandledordealtwithinaccordancewiththemaster’sbestjudgment.Inallcases,theemployer/mastershallcommunicatewiththemanningagencytoadvisefordispositionofseafarer’sremains.b.除死亡发生港口当地法律或法规要求不得转运遗骸外,雇主应将死亡船员遗骸及个人物品转运回中国,所有因此而产生的费用有雇主承担。如果死亡发生在海上,应根据船长良好职业判断处理过世船员遗骸。但无论如何,船长/雇主应该向过世船员的代理公司通报有关船员遗骸处理事宜。B.COMPESATIONANDBENEFITSFORINJURYORILLNESSB.工伤或因工作所导致疾病赔偿及福利C.Theabilitiesoftheemployerwhentheseafarersufferswork-relatedinjuryorillnessfuringthetermofhiscontractareasfollow:C.船员在合同期内因工作而导致的疾病或伤害,雇主应该承担以下责任:1.Theemployershallcontinuetopaytheseafarerhiswageshiswagesduringthetimeheisonboardvessel.1.船员受伤或生病后仍然在船期间,雇主应该继续支付船员工资。2.Iftheinjuryorillnessrequiresmedicaltreatmentinaforeignport,theemployershallbeliableforthefullcostofsuch12medical,surgicalandhospitaltreatmentaswellasboardandlodginguntiltheseafarerisdeclaredfittoworkortoberepatriated.However,ifafterrepatriation,theseafarerwillrequiresmedicalattentionarisingformsaidinjuryorillness,heshallbesoprovidedatcosttotheemployeruntilsuchtimeheisdeclaredfitorthedegreeofhisdisabilityhasbeenestablishedbythecompany-designatedphysician/hospital.2.如果工伤或疾病需要在国外港口进行治疗,雇主要承担所有药品,手术和住院费用也包括食宿费用到船员被宣布适合工作或返回雇佣地。如果返回雇佣地后船员还需要继续治疗的,雇主依旧要承担其医疗费用到船员痊愈或由雇主指定医生/医院宣布其残疾程度为止。3.Uponsign-offfromthevesselformedicaltreatment,theseafarerisentitledtosicknessallowanceequivalenttohisbasicwageuntilheisdeclaredfittoworkorthedegreeofpermanentdisabilityhasbeenassessedbythecompany-designatedphysician/hospitalbutinnocaseshallthisperiodexceedsixth(16)weeks.Forthispurpose,theseafarershallsubmithimselftoapost-employmentmedicalexaminationbyacompany-designatedphysician/hospitalwithinthreeworkingdaysuponhisreturnexceptwhenheisphysicallyincapacitatedtodoso,inwhichcase,awrittennoticetotheagencywithinthesameperiodisdeemedascompliance.Failureoftheseafarertocomplywiththemandatoryreportingrequirementshallresultinhisforfeitureoftherighttoclaimtheabovebenefits.3.因病治疗离船从离船开始,船员享有等同于其基本工资的疾病补助,疾病补助发放时间到疾病补助治愈或雇主所指定医生/医院宣布其残疾程度为止,但无论如何疾病补助发放时间不得超过16周。为了有效实施以上目的,船员应该于到达雇佣地后3日内由雇主所指定医生/医院签发合同终结后的体检报告,一旦船员客观上无法做到,船员以书面的方式通知其代理机构也可看作对以上要求的遵从。船员没能按上述要求执行可视为对获取上述权利的放弃。4.Uponsign-offtheseafarerfromthevesselformedicaltreatment,theemployershallbearthefullcostofrepatriationintheeventtheseafarerisdeclared(1)fitforrepatriation;or(2)fittoworkbuttheemployerisunabletofindemploymentfortheseafareronboardhisformervesseloranothervesselortheemployerdespiteearnestefforts.4.船员离船就医后雇主要对一下情况为船员提供前往雇佣地交通费用:(1)船员在国外就医后打到了返回雇佣地就以的条件而要返回雇佣地;(2)船员就医后已经适合重返工作岗位,但经过雇主全面努力后,船员已经不能返回原船或也没有合适的另一条船可供船员服务而需要返回雇佣地。5.IncaseofpermanenttotalorpartialdisabilityoftheseafarercausedbyeitherinjuryorillnesstheseafarershallbecompensatedinaccordancewiththescheduleofbenefitsenumeratedinP&IClubterms&seafarersocialsecurityinChina.Computationofhisbenefitsarisingfromanillnessordiseaseshallbegovernedbytheratesandtheruledofcompensationapplicableatthetimetheillnessordiseasewascontracted.5.一旦由于工伤或者疾病导致船员永久或部分残疾,船员应该根据保赔协会和船员在中国的社会保险项目获取赔偿。赔偿标准和赔偿额是以工伤和疾病发生时的保赔协会和社保相关项目标准进行计算。D.Nocompensationandbenefitsshallbepayableinrespectofanyinjury,incapacity,disabilityordeathoftheseafarerresultingformhiswillfullyorcriminalactorintentionalbreachofhisduties,providedhowever,thattheemployercanprovethatsuchinjury,incapacity,disabilityordeathisdirectlyattributabletotheseafarer.D.如果雇主能够证明因为船员本人故意行为、故意违反其工作职责而直接导致船员受伤、残疾和死亡的,船员不享有赔偿权利。E.Aseafarerwhoknowinglyconcealsanddoesnotdisclosepastmedicalcondition,disabilityandhistoryinthepre-employmentmedicalexaminationconstitutesfraudulentmisrepresentationandshalldisqualifyhimfromanycompensationandbenefits.Thismayalsobeavalidgroundforterminationofemploymentandimpositionoftheappropriateadministrationandlegalsanctions.E.船员明确知悉在上船前体检中隐瞒过往病史构成欺骗性误述,该类误述会取消其所有赔偿和补贴权利。该类误述也是有效终止该合同的条件,也是实施合适管理和法律制裁的依据。F.NocompensationandbenefitsshallbepayableinrespectofInjuryincurredotherwisethanintheserviceoftheship.F.船舶服务之外发生的其它受伤,船员不享有赔偿权利。G.Whenrequested,theprincipalshallfurnishtheseafareracopyallpertinentmedicalreportsoranyrecordsatnocosttotheseafarer.13G.当需要时,雇主应该为船员免费提供所有船员本人相关的医疗报告和记录。SECTION18.TRADINGAREA第十八部分航行区A.SeafareracknowledgesthattheVesselmaytradeworldwideatemployersolediscretion.A.船员确认知道在雇主的决定下船舶可以进行全球区域内航行B.IfthevesselsailstoawarproneareapromulgatedbyP&Icluborwarriskunderwriters,theEmployershallinformSeafarerandmanningagentinadvanceandensureSeafarer,ManningAgentagreeonthat.B.如果船舶驶往经过保赔协会公布的战争或者战争高风险区,雇主要提前通知海员及海员的代理机构,并确保得到海员和海员的代理机构同意海员随船前往上诉区域。C.Awarbonus,ifany,willbepaidtoSeafarerdirectlybytheEmployerC.如果有战区奖应该由雇主直接支付给海员本人。SECTION19.LOSSOFDAMAGETOCREW'SPERSONALEFFECTSBYMARINEPERIL第十九部分由于海难事故导致船员个人物品的损坏和丢失A.TheseafarershallbereimbursedbytheemployerthefullamountoflossordamagetohispersonaleffectsbutinnocaseshallbeamountexceedtotheamountofTwoThousandUSdollars(US$2000)ifhispersonneleffectsarelostordamagedasaresultofthewreckorlossorstrandingorabandonmentofthevesselorasaresultoffire,flooding,collisionorpiracy.A.由于海盗、碰撞、火灾、搁浅、沉没、弃船所导致的船员个人物品丢失或损坏,雇主应该对船员就此产生的全部财产损失进行赔偿,但最高赔偿额度不得超过2000美元B.Incaseofpartialloss,theamountshallbedeterminedbymutualagreementofbothpartiesbutinnocasetoexceedtotheamountofTwoThousandUSdollars(US$2000)B.如果只是部分损失,赔偿总额由双方共同商定,但中的赔偿额度不得超过2000美元C.Reimbursementforlossordamagetotheseafarer’spersonaleffectsshallnotapplyifsuchlossordamageisdueto(a)theseafarer’sownfault(b)larcenyortheftor(c)robberyC.因以下原因所导致的船员个人物品丢失或损坏雇主不进行赔偿(a)船员本人过错(b)盗窃(c)抢劫SECTION20SOCIALSECURITYFORSEAFARER第二十部分船员社会保险Onbehalfofemployer,manningagencyshallparticipateinworkinjuryinsurance,medicalinsurance,oldageinsurance,unemploymentinsuranceaswellasothersocialinsuranceinaccordancewiththerelevantprovisionsoftheState,andshallpaypremiumsontimeandinfullforseafarer.Abovefeealreadyincludeleavesubsistenceinmonthlywage.船员派遣公司代表雇主应当按照国家法律法规的规定为其招募的船员办理养老保险、医疗保险、工伤保险、失业保险、及其他国家法律规定的社会保险项目,并按时足额为船员缴纳其应当缴纳的各项费用。上述费用已包含在工资组成社保金部分。SECTION21.GENERALSAFETY第二十一部分总体安全要求A.Theseafarershallobserveandfollowanyregulationorrestrictionthatthemastermayimposeconcerningsafety,drugandalcoholandenvironmentalprotection.A.船员要遵从船长为实施安全管理、毒品和酒精政策和环保政策而制定相关规章制度或限制。B.Theseafarershallmakeuseofallappropriatesafetyequipmentprovidedhimandmustensurethatheissuitablydressedfrom14thesafetypointofviewforthejobathand.B.船员要充分利用好提供给他的安全防护设备并基于所从事工作的安全考虑确保安全防护设备已经合理穿戴。SECTION22.DISPUTESETTLEMENTPROCEDURES第二十二部分争端解决程序Incaseofclaimsanddisputesarisingfromhisemployment,thepartiescoveredbycontractshallsubmittheclaimordisputetotheoriginalandexclusivejurisdictionofthevoluntaryarbitratororpanelofarbitratorinShanghaiChina.如果因实施该合同而会产生了争议和索赔事项,该合同各方应该将争议和索赔提交在中国上海的仲裁机构、仲裁人、或相关法律管辖机构进行。SECTIONG23.PRESCRIPTIONOFACTION第二十三部分诉讼时效Allclaimsarisingformthiscontractshallbemadewithin(3)yearsformthedatethecauseofactionarises,otherwisethesameshallbebarred.因该合同而产生的索赔应该在事发日后三年内进行,否则不再有诉讼权。SECTION24.APPLICABLELAW第二十四部分使用法律Anyunresolveddispute,claimorgrievancearisingoutoforinconnectionwiththiscontractincludingtheannexesthereof,shallbegovernedbythelawsofthePeople’sRepublicofChina,internationalconventions,treatiesandconventionswherethePeople’sRepublicofChinaisasignatory.所有本合同及本合同附属部分有关而未解决的争议、索赔或投诉应该按中华人民共和国法律、中华人民共和国所缔结和签署的国际公约、条约进行处理。INWINTNESSWHEREOFthepartiesheretosettheirhandsthis19thdayofMar.2013atFUJIANCHINA特此证明:各有关方于2013.03.19在中国福建签署协议NOTE:ThisagreementiscompiledinbothChinese(andotherworkinglanguage)andEnglishversions.ShouldanydiscrepancyOccuri
